GENERAL CONDITIONS OF SALE
Online sale of products from the company Garçonne & Chérubin.
These general conditions of sale apply between:
Garçonne & Chérubin, with a capital of 20,000 euros, having its registered office at 83, rue de Turenne, 75003 Paris - France, registered in France with the Paris Trade and Companies Register under number 791 898 919, NAF code 4791B, publisher of the website www.gcparis.com
Hereinafter: “Tomboy & Cherub”
And :
Anyone making a purchase on the website www.gcparis.com
Hereinafter: “The Client”
The Client declares that he/she has the capacity to enter into this contract, i.e. that he/she is of legal age and not under guardianship.
The order by the Customer implies irrevocable acceptance of these general conditions of sale.
The sales contract is subject to French law.
1. Validity of offers
Offers are only available to consumers with a delivery address in countries where Garçonne & Chérubin ensures delivery via a transport service provider.
The products presented on the site are valid while stocks last. In the event of a debit or collection for the order of an unavailable item, Garçonne & Chérubin undertakes to reimburse the Customer within 30 days. Garçonne & Chérubin undertakes to notify by email the Customer who has ordered an unavailable item.
2. Presentation of products
The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, the responsibility of Garçonne & Chérubin could not be engaged.
The photos depicting our products are for illustrative purposes only. These photos, like the text illustrating the products, are not contractually binding.
Garçonne & Chérubin may, due to its suppliers, be required to deliver to the Customer an item of composition slightly different from that described but in any event of equal or superior quality to the item ordered.
3. Price
The prices displayed on the website or online store are final. They are indicated in Euros (€) and are governed by French law. They are inclusive of all taxes (VAT) except for Customers who have provided a delivery address located outside the European Union, in which case the prices are exclusive of taxes.
They are guaranteed subject to typographical or printing errors.
These prices do not include the fixed contribution to shipping and packaging costs, which remains the responsibility of the customer, except in the case of a temporary or permanent promotional offer.
Prices may be modified at any time, without notice, particularly in the event of changes in tax or economic data. Items will be invoiced based on the rates in effect at the time the order is placed.
4. Payment terms
Products or services must be paid for in Euros (€). Bank charges incurred by payment, regardless of the method, will be charged to the Customer.
The delivered goods remain the property of Garçonne & Chérubin until receipt of payment. The transfer of risks occurs upon delivery of the goods.
The accepted payment method is Bank Card (CARTE BLEUE / VISA / MASTER CARD / AMERICAN EXPRESS) as well as the PAYPAL payment service.
5. Acceptance of the offer
Any order constitutes express and irrevocable acceptance of the prices and descriptions of the products available for sale. Validation of the order by the Customer constitutes acceptance of the general conditions of sale.
6. Invoice
The invoice is sent to the email address provided when ordering. It is established in accordance with the price list in effect on the day the order is placed. Garçonne & Chérubin disclaims all responsibility for data entry errors.
7. Delivery-Transport
Garçonne & Chérubin products are delivered worldwide.
Orders placed before 11am (GMT+1) Monday to Friday are shipped the same day (except on public holidays). Orders placed after 11am are shipped the following business day. This timeframe is provided for informational purposes only and is subject to actual receipt of payment.
The shipments are then handled by a transport service provider (Colissimo) which ensures transport to the delivery address indicated by the customer. The delivery times indicated by the carriers are as follows:
In Metropolitan France: 2 to 4 working days (deliveries from Monday to Saturday).
In Europe: 4 to 7 working days.
Rest of the world: 8 to 15 working days.
All these deadlines are given for information purposes only. Exceeding these deadlines cannot under any circumstances be held against you. Garçonne & Chérubin , nor give rise to termination of the contract or to any compensation for damages.
The risks of transport are borne by the Customer from the moment they leave the warehouse. The customer must check the condition of the packaging and the conformity of the delivered items and immediately report them to Garçonne & Chérubin any anomalies, if any. Any reservations should be noted on the delivery slip presented by the carrier and should be sent within 48 hours by email to: customers@gcparis.com.
If the country of delivery is not part of the European Union, customs duties will be charged to the recipient. Garçonne & Chérubin has no control over these charges which are the sole responsibility of the Client.
8. Right of withdrawal
If one or more items are not suitable, the Customer has 14 days from the date of delivery of the goods to exercise the right to withdraw from their order. The postmark or the date of the receipt of availability constitutes the start date of this period. The return or cancellation may concern all or part of the order.
To do this, the Customer must send an email to customers@gcparis.com with the order number and specify the name of the product to be returned.
In mainland France, return costs are the responsibility of Garçonne & Chérubin , unless the customer benefited from an offer or promotional operation during their purchase, in which case each returned package (for exchange or refund) will be charged €10.
Reimbursement will be made within a maximum of 30 working days from receipt of the returned goods by re-crediting the bank card used for the purchase, after checking that the item and its packaging are in good condition.
Costs relating to transport costs for exchange and/or refund requests from abroad (including French overseas departments and territories) are entirely the responsibility of the customer.
Damaged, incomplete or soiled products will not be returned or refunded.
Beyond the 14-day period from delivery, products will not be returned or refunded.
9. Obligation of the parties
Garçonne & Chérubin , in the event of acceptance of an order, undertakes to sell and deliver to the Customer the products ordered by the latter according to the terms specified above.
Garçonne & Chérubin is committed to verifying that the products comply with French regulations.
The Client undertakes to indicate to Garçonne & Chérubin an address to which delivery can be made. The provision of personal information (name, address, telephone number, email address) collected for the purpose of concluding the sales contract is mandatory. This information is essential for processing and delivering orders and issuing invoices. Failure to provide this information will result in the order not being validated. In the event of an error in providing this information, Garçonne & Chérubin cannot be held responsible for the impossibility of delivering the product. In this case, the customer remains responsible for payment.
If an incomplete address is provided, resulting in the transport provider being unable to deliver, the Customer must pay the delivery costs corresponding to the reshipment of their order.
10. Personal data
The collection of the Customer's personal data is necessary for processing the order. This information is strictly confidential and is intended for the sole use of Boy & Cherub .
In accordance with the Data Protection Act of 6 January 1978, the Client has the right to access, modify, rectify and delete personal data concerning him/her. If the Client wishes to exercise this right, he/she simply needs to write to Garçonne & Chérubin , 83, rue de Turenne – 75003 Paris, France, indicating your name, first names and address.
Garçonne & Chérubin reserves the right to collect data on the Customer through the use of cookies in order to improve the personalized service intended for the Internet user.
11. Liability
Garçonne & Chérubin cannot be held liable for any inconvenience or damage relating to the use of the Internet, such as a break in service, the presence of computer viruses or external intrusions, or more generally any cases deemed force majeure by the courts.
12. Miscellaneous provisions
The invalidity or unenforceability of any clause of these general terms and conditions of sale or of the special conditions shall not affect the application or validity of the other clauses of the general terms and conditions of sale. This clause shall then be replaced by the closest possible provision.
Neither Garçonne & Chérubin , nor the Client, may be held liable in the event of contractual non-performance resulting from a case of force majeure, in particular and without limitation in the event of war, riot, insurrection, interruption of transport, import problem, strike, shortage, fire, earthquake, storm, flood.

13. Applicable law and competent court
These general conditions of sale are governed exclusively by French law.
The commercial courts of Paris have sole jurisdiction in the event of any dispute or difference concerning them.
